ADMINISTRATIVE COMMENTS:

The proposed code amendment adds a new use ‘Smoking Establishments’ and requires a special use permit (SUP) for this use in the Old Town Mixed Use-2 (OTMU-2), Mixed Use (MU), General Business (GB), General Business 2 (GB-2) and Light Industrial (LI) zoning districts. Cigar bars, cigar lounges, hookah bars, hookah lounges, and cigarette lounges have been growing in popularity and are not clearly defined or addressed in the Unified Development Code. Furthermore, there are significant health risks along with odors and fumes associated with smoking that could be detrimental to other tenants or properties. Other uses with on-site consumption of age-controlled substances, namely bars, are regulated by the Texas Alcoholic Beverage Commission and require SUP approval. The Planning and Zoning Commission recommended unanimous approval (5-0) on June 4, 2024.

RECOMMENDATION:

That the City Council approve the ordinance as set forth in the caption above.
