ADMINISTRATIVE COMMENTS:
The City Council previously approved the AIA A141 Design Build Agreement for Preconstruction Services for the Fire Training Structures for CORE Construction Services of Texas, Inc., in the amount of $336,000 on September 12, 2022; and a Design Build Amendment for Construction Services for the project for $6,486,352 on September 18, 2023. This Contract Sum included an Owner's Contingency of $373,380. During excavation for the foundations for the new structures very large amounts of ground water flooded the future location of these two new facilities. The successful solution for mitigating this water infiltration required a significant amount of additional material, labor, and equipment costs, and drove a five month delay to the project. The current cost projection is approximately $600,000 for the known water intrusion impacts, pending negotiations. The estimated total cost to address the known water intrusion impacts is approximately $600,000, pending final negotiations. To cover this amount and to replenish the Owner's Contingency to $174,863 for future unforeseeable risks, an additional $395,000 is required within the Design Builder's Contract Sum. Staff is authorized to sign change orders within the designated contingency for this project. However, the work required to address the unforeseen water intrusion exceeds our available contingency amount, thus requiring Council approval.
