ADMINISTRATIVE COMMENTS:

Texas-New Mexico Power Company (“TNMP”) filed an application on or around September 1, 2026, with the Public Utility Commission of Texas (“PUC”), seeking to file for the approval of a single unified tracker mechanism (“UTM”) under PURA § 36.216. The Texas Legislature enacted PURA § 36.216 in Texas House Bill 5247 to streamline certain electric utility rate proceedings into a single, annual proceeding. Pursuant to this new legislation, eligible electric utilities may elect to file an application in a UTM proceeding to reflect changes in transmission and distribution invested capital.  TNMP is an eligible utility.  This will be TNMP’s first UTM proceeding under the new legislation.  Several cities have already filed a motion to intervene. The cities’ rate case expenses are reimbursable because this is a rate proceeding.  This resolution authorizes the City to intervene in TNMP’s UTM proceeding before the PUC, to cooperate with the intervening cities to prepare a common response, and to hire legal counsel and consultants to negotiate with TNMP and direct necessary litigation.

RECOMMENDATION:

That City Council approve the resolution as set forth in the caption above.
